OUR TWO ROLES: CONTROLLER AND PROCESSOR
We process personal information in two distinct capacities, and your rights and our obligations differ between them.
As a controller. Durable Intelligence is the controller (or "business" under US state privacy laws) of personal information it collects for its own purposes, including contact information you provide, account and integration information, and technical log data collected automatically. Durable Intelligence determines the purposes and means of that processing, and this Privacy Notice describes it.
As a processor. Customer Content, meaning prompts, agent inputs, tool outputs, files, and other content submitted through the Services, may incidentally contain personal information, including sensitive personal information, that the submitting customer controls. We do not request, require, or solicit such information. Where Customer Content contains personal information, we process it as a processor (or "service provider") solely on the customer's instructions to provide, maintain, secure, troubleshoot, evaluate, and support the Services, and for no other purpose. The customer is responsible for that information, including any required notices, consents, and lawful bases. Where required, a data processing addendum governs that processing. If you believe your personal information has been submitted to the Services by one of our customers, direct your inquiry to that customer; we will support the customer's response as required by law and our agreements.
We do not use Customer Content to train general-purpose machine-learning models unless you or your organization expressly agree otherwise in writing.

1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide when you express interest in obtaining information about us or our products and Services, when you create an account or integration, or otherwise when you contact us. This may include:
- Name and business contact details (email address, organization)
- Account, credential, and integration information
- Communications you send us
We do not request or collect sensitive personal information (such as racial or ethnic origin, religious beliefs, health information, or precise geolocation) for our own purposes.
Customer Content. Content submitted through the Services may incidentally contain personal information of any kind, including sensitive personal information. That content is processed under the processor terms described in "Our Two Roles" above and is not collected by Durable Intelligence for its own purposes. Do not submit credentials, regulated data, or highly sensitive information unless your deployment and agreement with Durable Intelligence are designed for that information.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes.
Information automatically collected
In Short: Certain information, such as your Internet Protocol (IP) address and browser and device characteristics, is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information may include device and usage information, including your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country or region derived from IP address, information about how and when you use our Services, and other technical information. This information is needed to maintain the security and operation of our Services and for internal analytics and reporting.
We use product analytics, including cookies and recordings of how pages are used (with anything you type hidden), to understand how our websites and products are used and to improve them, and we may link it to your account or the contact details you give us. In our products this is limited to usage and technical events, such as which features are used, when, and how they perform, and never includes your prompts, code or project content.
We do not collect precise device geolocation.
The information we collect includes:
- Log and Usage Data. Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services, recorded in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings, information about your activity in the Services (such as date/time stamps, features used, and other actions), and device event information (such as system activity, error reports, and hardware settings).
2. HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law.
We process personal information for the following purposes:
- To deliver and facilitate delivery of the Services.
- To respond to inquiries and offer support.
- To send administrative information, including details about our products and services and changes to our terms and policies.
- To administer direct subscriptions and billing. Where Durable Intelligence provides paid Services directly, we may process information to administer subscriptions, usage, billing, payments, and applicable taxes. Billing handled by third-party platforms is subject to those platforms' terms and privacy practices.
- To protect our Services, including security monitoring, abuse detection, and fraud prevention.
- To evaluate and improve our Services, including reliability, safety, performance, and user experience, and to identify usage trends.
- To comply with our legal obligations, respond to legal requests, and exercise, establish, or defend legal rights.
Customer Content is processed solely as described in "Our Two Roles" above.
3. WHAT LEGAL BASES DO WE RELY ON (EEA/UK)?
In Short: Where the EU or UK General Data Protection Regulation applies, we process personal information only with a valid legal basis.
Where we act as a controller and the GDPR or UK GDPR applies, we rely on the following legal bases:
- Performance of a contract (Article 6(1)(b)): to provide the Services you or your organization have requested.
- Legitimate interests (Article 6(1)(f)): to secure and improve the Services, prevent fraud and abuse, and communicate about the Services, where those interests are not overridden by your rights.
- Legal obligation (Article 6(1)(c)): to comply with applicable law.
- Consent (Article 6(1)(a)): where we ask for it expressly, which you may withdraw at any time.
Where we process Customer Content as a processor, the customer is responsible for establishing the legal basis for that processing.
4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In Short: We may share information with service providers under written contracts and in the specific situations described below.
Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. Our service providers may process personal information only for purposes permitted under their agreements with us and as necessary to provide their services, subject to applicable legal and contractual obligations, and are required to use appropriate safeguards.
The categories of third parties we may share personal information with are:
- AI Platforms
- Cloud Computing Services
- Data Storage Service Providers
- Performance Monitoring Tools
- User Account Registration & Authentication Services
- Website Hosting Service Providers

We may also need to share personal information in the following situations:
- Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
- Legal Requirements. We may disclose information where required to comply with law, legal process, or enforceable government requests, or to protect the rights, property, or safety of Durable Intelligence, our users, or others.
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.
5. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?
In Short: We offer products powered by artificial intelligence, and third-party platforms and model providers may process data to enable them.
As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). The terms in this Privacy Notice govern your use of the AI Products within our Services.
Use of AI Technologies. We may provide the AI Products through third-party platforms and model providers, including OpenRouter and the underlying providers selected or routed through the Services. Your input, output, and personal information may be shared with and processed by these providers as necessary to enable your use of our AI Products, for purposes outlined in "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" You must not use the AI Products in any way that violates the terms or policies of any AI service provider.
Data path. When you access Nenya through OpenRouter, OpenRouter transmits your request to Durable Intelligence; Durable Intelligence processes it to provide continuity and coherence and may forward content to the underlying model provider handling the request; and the response returns through the same path. OpenRouter and each model provider collect, retain, and process data under their own terms and privacy policies, independently of Durable Intelligence. Durable Intelligence's own retention of content is described in "HOW LONG DO WE KEEP YOUR INFORMATION?"
Our AI Products are designed for the following functions:
- AI research
- AI deployment
How We Process Your Data Using AI. Personal information processed through our AI Products is handled in accordance with this Privacy Notice and our agreements with third parties, including the processor terms in "Our Two Roles" above.
6. INTERNATIONAL DATA TRANSFERS
In Short: We are based in the United States, and personal information may be transferred there and to other countries.
We are headquartered in the United States, and personal information may be processed in the United States and in other countries where we or our service providers operate. These countries may have data protection laws different from those of your country.
Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland to countries that have not received an adequacy determination, we rely on appropriate safeguards, including the standard contractual clauses approved by the European Commission and, for UK transfers, the UK International Data Transfer Addendum. Copies of the relevant safeguards are available on request at contact@qwntl.com. Where we process Customer Content as a processor, transfer mechanisms are addressed in the applicable data processing addendum.
7. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.
We retain personal information only for as long as necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law.
Prompt and Output Logging. Nenya is designed to maintain agent state and continuity across requests, which requires retaining certain content submitted through the Services for the duration of the applicable session or deployment. Where content logs (prompts, agent inputs, tool calls, tool outputs, and model outputs) are created to operate, secure, troubleshoot, evaluate the reliability, safety, and performance of, or support the Services, they are retained for no more than 180 days, unless a different period or configuration is specified in an applicable customer agreement, after which they are deleted or de-identified, except where retention is required by law. We do not use these logs or any other Customer Content to train general-purpose machine-learning models unless you or your organization expressly agree otherwise in writing.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because it has been stored in backup archives), we will securely store it and isolate it from further processing until deletion is possible.
8. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, and we cannot guarantee that unauthorized third parties will not defeat our security measures or improperly collect, access, alter, or disclose your information. Transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
9. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market to children under 18 years of age.
The Services are offered for business use only and are not directed to children. We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18. If we learn that personal information from users under 18 has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under 18, contact us at contact@qwntl.com.
10. WHAT ARE YOUR PRIVACY RIGHTS?
In Short: Depending on your location, you may have rights to access, correct, delete, or restrict the processing of your personal information.
EEA, UK, and Switzerland. Where the GDPR, UK GDPR, or Swiss data protection law applies and we act as a controller, you have the right to request access to your personal information, rectification, erasure, restriction of processing, and portability, and to object to processing based on legitimate interests. Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of processing before withdrawal. You also have the right to lodge a complaint with your local supervisory authority. Where we process personal information as a processor within Customer Content, direct requests to the customer that submitted it; we will support the customer's response as required by law and our agreements.
Withdrawing your consent. If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us using the details in "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below. Withdrawal will not affect the lawfulness of processing before withdrawal nor, where applicable law allows, processing conducted in reliance on lawful grounds other than consent.
If you have questions or comments about your privacy rights, email us at contact@qwntl.com.
11. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
12. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short: If you are a resident of a US state with a comprehensive privacy law, you may have rights to access, correct, delete, and obtain a copy of your personal information.

These rights may be limited in some circumstances by applicable law.
